VIA Rail and the Government of Canada Honour Canadian Forces and Veterans with Free Rail Travel

OTTAWA, May 31 /CNW Telbec/ - Today, the Honourable Rob Merrifield, Canada's Minister of State (Transport) and Donald A. Wright, VIA Rail Canada Chairman of the Board, announced the third year of VIA Rail's Canadian Forces Family Appreciation fares to celebrate the contribution made to the country by Canada's military personnel and veterans. They were joined at the Ottawa Train Station by the Honourable Jean-Pierre Blackburn, Minister of Veterans Affairs and Minister of State (Agriculture); the Honourable Peter MacKay, Minister of National Defence and Marc Laliberté, VIA Rail Canada President and CEO.

Between July 1 and August 14, 2010, active or retired Canadian Forces personnel and veterans will be entitled to free Economy class rail travel on selected trains across the entire VIA network. In addition, Canadian Forces personnel and veterans will be eligible for a 25% discount off the best available fares for travel in both Business and Sleeper class. Each active or retired Canadian Forces member may also bring up to five immediate family members with them, at a 25% discount off the best available fare in any class of service. The Canadian Forces Family Appreciation fare can also be combined with VIA's children's' summer travel discounts.

"This is a great chance for us to celebrate the members of the Canadian Forces personnel and their families and show them how proud we are of the work they do," said Minister Merrifield. "Our Government is proud to support VIA as they extend this initiative for a third year."

                       Free VIA Rail Travel this Summer

Active and retired Canadian Forces personnel, reservists, spouses and dependants are eligible for the special fares. Members of the Canadian Forces travel free on select trains in Economy class and can bring up to five family members travelling with them at 25 per cent off the regular applicable fare. Up to five children under 12 accompanied by an adult can travel at $10 each as part of VIA's kids summer travel discount. VIA is also offering a 25 per cent discount to military personnel and their families off the best available fare in Business and Sleeper classes, depending on availability. I would like to inform all members of the Canadian Forces that I have written to the Chair of the Special Committee on the Canadian Mission in Afghanistan regarding recent testimony of Mr. Ahmadshah Malgarai.

 

Here is the text of that letter.

Mr. Chair,

 

I am writing to you today to provide factual information following accusations made by Mr. Ahmadshah Malgarai on April 14th, 2010 before the Committee. Mr. Malgarai made a number of accusations in his appearance that are being looked into by the Canadian Forces, but by far the most egregious was that a Canadian Forces member unlawfully shot and killed an individual in 2007.

 

Based on the information disclosed in Mr. Malgarai's testimony, the Canadian Forces have every reason to believe that we have identified the event in question.

 

During the night from the 18th and 19th of June 2007, a Canadian-led operation, supported by Afghan and coalition forces, was launched on a compound associated with IED-making activity. The compound was suspected to be a staging area for rocket attacks against Kandahar Airfield as well as IED attacks against Canadian and coalition soldiers. Details of this event are very well documented. A full year of intelligence gathering by the CF and its coalition partners was done before this Canadian-led operation. 

 

Operation reports which unfortunately cannot be made public as they contain sensitive information about tactics, techniques and procedures, indicate that during the mission an armed individual posed a direct and imminent threat to CF soldiers as they entered the compound. A shooter who was providing support to the operation identified the individual and assessed that he was a threat, and shot the individual. The actions of the shooter were an appropriate application of the rules of engagement and saved the lives of a number of Canadian Forces members that night. This individual was armed and was never detained.

 

During the course of the operation, ten Afghans were detained.  Nine of these detainees tested positive for explosive residue.  In accordance with standard procedures, these detainees were taken to Kandahar Airfield where they were processed and determined to be uninjured and in good health.  During tactical questioning of the detainees, two individuals made allegations that coalition forces had planted a pistol on the deceased insurgent.  It is worth noting that one of the two individuals later retracted his allegation.

 

Immediately following the mission, an after-action review was conducted to review the actions and outcomes of the operation. It was determined that all applicable rules of engagement and theatre standing orders were followed.

 

As you are well aware, before transferring a detainee into Afghan custody, the Canadian Task Force Commander must be satisfied that there is no substantial grounds for believing that there exists a real risk that the detainee would be in danger of being subjected to torture or other forms of mistreatment at the hands of Afghan authorities. The Canadian Forces do not transfer individuals for the purposes of gathering information.  

 

In this particular case, the Commander at the time considered all the relevant information at his disposal and made the determination to transfer all ten individuals to the NDS in order to allow Afghan authorities to determine whether criminal prosecution was warranted. This is in accordance with our detainee transfer arrangements with the Government of Afghanistan .  All individuals transferred were properly monitored and tracked through Canada 's monitoring mechanisms.

 

I want all committee members to know that the Canadian Forces take all allegations seriously and will investigate new allegations appropriately.  Whenever there have been specific allegations, the Canadian Forces have not hesitated to act. As a result of Mr. Malgarai's testimony, the Canadian Forces National Investigation Service is conducting an investigative assessment. And we welcome any individual who has any relevant information about this event to come forward and provide a sworn statement.

 

It is important for committee members as well as Canadians to recognize that we are conducting operations in a hostile environment. The Canadian Forces have always been and remain committed to ensuring that detainees are handled and transferred in accordance with our obligations under international law.  We believe in upholding the values of justice, respect for human rights and the dignity of the individual. 

 

Finally, I think that it is important to keep in mind the good work that the men and women are doing in Afghanistan . Since the beginning of our engagement in Afghanistan , some 30,000 soldiers, sailors and airmen and women have helped the people of Afghanistan build towards a brighter future.  These men and women in uniform are in harm's way. They are working on behalf of all Canadians in very difficult conditions and they continue to demonstrate great bravery and compassion.

 

I trust that this information gives you a clearer picture of what actually happened on the ground that evening in June 2007 and demonstrates the lengths to which the Canadian Forces go to ensure we conduct ourselves professionally, honourably and in accordance with the rule of law.

Je vous écris aujourd'hui pour vous communiquer des faits à la suite des accusations portées par M. Ahmadshah Malgarai dans son témoignage du 14 avril 2010 devant le Comité. Ces accusations, dont la plus flagrante est qu'un soldat canadien aurait tiré illégalement sur quelqu'un et l'aurait tué en 2007, sont en train d'être examinées par les Forces canadiennes.

 

À partir des informations divulguées dans le témoignage de M. Malgarai, les Forces canadiennes ont tout lieu de croire qu'elles ont déterminé l'événement en question.

 

Durant la nuit du 18 au 19 juin 2007, une opération dirigée par le Canada et appuyée par les forces afghanes et de la coalition a été lancée dans un complexe ou l'on fabriquait des engins explosifs. On soupçonnait que ce complexe servirait à lancer des attaques à la roquette contre le terrain d'aviation de Kandahar ainsi qu'à fabriquer des engins explosifs qu'on utiliserait contre les soldats canadiens et de la coalition. Les détails de l'événement sont parfaitement documentés. Les FC et leurs partenaires de la coalition avaient passé une année complète à recueillir du renseignement avant le lancement de l'opération. 

 

Selon des rapports de l'opération, qui ne peuvent malheureusement pas être rendus publics car ils contiennent des informations de nature délicate sur les tactiques, les techniques et les procédures utilisées, quelqu'un a posé, au cours de la mission, une menace directe et imminente pour les soldats canadiens qui pénétraient dans le complexe. Un tireur qui appuyait l'opération l'a repéré, a estimé qu'il présentait une menace et a tiré sur lui. Son action était conforme aux règles d'engagement et a sauvé cette nuit la vie de militaires canadiens. La personne en question était armée et n'avait jamais été détenu.

 

Au cours de l'opération, dix Afghans ont été faits prisonniers, dont neuf portaient sur eux des résidus d'explosifs. Conformément aux procédures en vigueur, ils ont été conduits sur le terrain d'aviation de Kandahar où l'on a constaté qu'ils n'étaient pas blessés et qu'ils étaient en bonne santé. Au cours de l'interrogatoire tactique des détenus, deux personnes ont allégué que les forces de la coalition avaient placé un pistolet sur l'insurgé décédé. Il convient de noter que l'une d'elle s'est par la suite rétractée.

 

Immédiatement après la mission, on a examiné les opérations menées et leurs résultats, et déterminé que l'on avait suivi toutes les règles d'engagement et instructions permanentes en vigueur.

 

Comme vous le savez bien, avant de transférer un détenu sous la garde des Afghans, le commandant canadien de la force opérationnelle doit être convaincu qu'il n'y a pas de raison suffisante de croire qu'il existe un risque réel que le détenu soit en danger d'être soumis à la torture ou à d'autres formes de mauvais traitements entre les mains des autorités afghanes. Les Forces canadiennes ne transfèrent personne aux fins de collecte d'information.  

 

Dans ce cas particulier, le commandant a examiné toutes les informations pertinentes mises à sa disposition et décidé de transférer les dix prisonniers à la Direction de la sécurité nationale pour laisser aux autorités afghanes le soin de déterminer si des poursuites au criminel étaient justifiées. Cette approche est conforme aux arrangements de transfert de détenus que nous avons conclus avec le gouvernement de l'Afghanistan. Tous les transferts ont été convenablement contrôlés et les mécanismes de suivi appliqués.

 

Je tiens à ce que les membres du Comité sachent que les Forces canadiennes prennent toutes les allégations au sérieux, enquêtent sur elles et feront enquête sur toutes les nouvelles allégations. Chaque fois qu'il y en a eues, les Forces Canadiennes n'ont pas hésité à agir. À la suite du témoignage de M. Malgarai, le Service national des enquêtes des Forces canadiennes procède à une évaluation. Et nous invitons quiconque est en possession de renseignements pertinents à l'événement à se manifester et à faire une déclaration sous serment.

 

Il est important que les membres du Comité, de même que tous les Canadiens et Canadiennes, reconnaissent que nous menons des opérations dans un milieu hostile. Les Forces canadiennes se sont toujours engagées – et continueront de le faire – à ce que les détenus soient traités et transférés dans le respect de nos obligations en vertu du droit international. Nous croyons dans la défense des valeurs de la justice, et dans le respect des droits et de la dignité de la personne. 

 

Je crois enfin qu'il importe de ne pas oublier le bon travail que les hommes et les femmes exécutent en Afghanistan. Depuis le début de notre engagement dans ce pays, quelque 30 000 hommes et femmes soldats, marins et aviateurs ont aidé le peuple de l'Afghanistan à bâtir un avenir meilleur. Ces hommes et ces femmes en uniforme courent des dangers. Ils œuvrent au nom de tous les Canadiens et Canadiennes dans des conditions très difficiles et continueront de faire preuve de grandes bravoure et compassion.

 

Je crois que cette information vous donnera une idée plus précise de ce qui est réellement arrivé sur le terrain en cette soirée de juin 2007 et de toutes les peines que se donnent les Forces canadiennes pour faire en sorte que nous nous conduisions de façon professionnelle et honorable, et conformément à la primauté du droit.

John Gebhardt's wife, Mindy, said that this little girl's entire family was executed. The insurgents intended to execute the little girl also, and shot her in the head...but they failed to kill her. She was cared for in John's hospital and is healing up, but continues to cry and moan. The nurses said John is the only one who seems to calm her down, so John has spent the last four nights holding her while they both slept in that chair. The girl is coming along with her healing.
